Welcome to our guide that asks, ‘Is Stake legal in Washington State?’ and gives you a very simple answer. Essential reading for anyone in the Evergreen State who wants to play at Stake.us.
Not only can you not play at Stake.com anywhere in the US, but you can’t use the Stake.us sweepstakes casino in Washington State either. Thankfully, we’ve found a great charitable social casino that you can use here, and what’s even better, is that it has a welcome offer that’s as good as the exclusive STFSOCIAL code at Stake.us.
Washington State doesn’t permit any kind of real money online casino gaming. As well as this, the state has proven to be very resistant about letting any sweepstakes casino gaming sites operate within its state borders.
You can see evidence of this in the Stake.us terms and conditions page, where Washington is listed alongside New York, Nevada, Kentucky, Idaho, Vermont and Michigan as the states that the brand doesn’t accept players from. So if you want to play sweepstakes casino games in Washington, you’ll have to head elsewhere.
Sweepstakes casinos like Stake often make use of a virtual currency system, in this case Gold Coins and Stake Cash. This violates RCW 9.46.0335, as participating in sweepstakes raffles often requires a monetary exchange rather than free entry. Not only that, but because Stake is a for-profit entity, it does not qualify under RCW 9.46.0315 to conduct raffles.
Unfortunately for sweepstakes fans, there isn't any current legislation proposing to legalize sweepstakes casinos in Washington. However, the online gaming landscape is always changing. In recent years, other states such as Michigan have expanded their online gaming laws to permit sweepstakes casinos to operate legally in the region, although you'll need to check our guide 'Is Stake.us legal in Michigan?' for more details on this.
However, given Washington's historical resistance to online casinos, it's safe to assume that Stake won't be available in the state anytime soon. If you're a WA resident, I'd suggest looking into legal alternatives for casino-style gaming.
Washington isn't the only state that Stake is restricted in. Here are some more details on the other states where Stake is prohibited, and why:
Like Washington, Idaho has stringent anti-gambling laws in place that prohibit most forms of online gaming, including sweepstakes casinos like Stake. The state's legislation does not provide exceptions for sweepstakes gaming models, so naturally Stake isn't available here.
Kentucky is another state that strictly enforces their regulations against online gambling activities. The state's legal framework allows for horse racing and a state lottery, however it does not accommodate sweepstakes casinos. Because of this, Stake's operations are prohibited in the region.
While Michigan legalized some forms of online gambling in 2019, (including online casinos and sports betting), the state's gambling laws impose specific licensing requirements. The state requires sweepstakes operators to obtain specific licenses and adhere to the state's regulatory standards. As of now, Stake.us does not hold the necessary licensing to operate legally in Michigan, hence its restriction.
Despite being known for its gambling industry, sweepstakes casinos like Stake don't fit neatly into Nevada's gambling legislation. In-person and online gambling is permitted in some forms, however sweepstakes casinos are excluded from operating in the area. The state regulates online gambling strictly, requiring operators to obtain specific licenses to be allowed to operate in the region.
New York's legal framework regarding gambling is complex, allowing certain forms like state-run lotteries and regulated casinos. However, the state prohibits most forms of online gambling, including sweepstakes casinos. The state's gambling laws do not support the operation of online casinos like Stake, and so it's unfortunately restricted.
Vermont enforces strict anti-gambling laws that disallow a lot of online gaming activities. The state's regulations currently don't have a framework for sweepstakes casinos, so Stake is prohibited in the state.
Currently, Stake operates legally in 43 states across the country. These states can access Stake's full suite of features, including the welcome bonus of 55 Stake Cash + 260K Gold Coins + 5% Rakeback. Here's a list of all the states that Stake is and isn't legal:
